Road Use Agreements


Road Use Agreements (RUA) are used to ensure the Prime Contractor is aware of the responsibilities and policies the Municipality has in place for movement on roads under their control. The agreements allow the Municipality to impose specific conditions for the occupancy of a lease or roadway based on current Municipal policy.

When a Municipality has adopted a policy to require Road Use Agreements, RDS will work with the Municipality, Road User and Prime Contractor to ensure all required documentation is in place. In the majority of situations, an executed Road Use Agreement must be in place prior to the Road User or Prime Contractor receiving any approvals to move on roadways within the Municipality. It is recommended that a Prime Contractor be aware of when a RUA is required and work to have this document established before a project commences, otherwise delays may be experienced.

There are three types of RUA’s – Annual, Site Specific and Single Trip. Each Municipality will have different needs that justify the type of Road Use Agreement is implemented in each Municipality.

1. Annual Road Use Agreements


Issued to the Prime Contractor or Carrier and are valid for either a single year term or they are continuous for the amount of time the Prime Contractor or Carrier is doing business in the Municipality. They provide a blanket agreement for all roads within the Municipality.

2. Site Specific Road Use Agreements


Issued to the Prime Contractor for a specific LSD or Facility. They are valid for a single year or the length of time the Prime Contractor is the owner of the LSD of Facility. All sub-contractors hired by the Prime Contractor have permission to use the RUA as long as all conditions of the RUA are followed. Some Site Specific Road Use Agreements list a designated route of travel that must be followed from the nearest highway to the location.

3. Single Trip Road Use Agreements


Issued to the Prime Contractor or Carrier and are valid for a single trip from point to point using a designed route.
